The GDP growth rate is back to 6% + in the last 3 financial years ie. 2014-2017. During this period, we also witnessed major policy changes viz. Demonetization, Implementation of GST. India is the second most populous nation with a work force of over 500 million people. To drive economic growth, it is important to have contemporary Labour Laws and practices aligned to global markets.
As per the Constitution of India, Labour matters fall in the Concurrent list, thereby given power to both the Central and State Government to legislate on Labour matter, with the residual law-making powers vested with the Central Government. This is resulted in multiple Laws pertaining to Wages, Employment, Industrial Relations, Benefits, etc.
Over the last 3 years, the Central Government has been pursuing a reform agenda with an overall aim to simplify Labour regulations. The Ministry of Labour and Employment(MoLE), Government of India has recently conveyed that the aim is to first concentrate on reforms which are focused on employee welfare and benefits.Some recent amendments include changes to Maternity Benefits Act, Payment of Bonus Act, Child Labour Amendment Act, etc
Over a period of time, the (MoLE), Government of India is in the process of amalgamating the relevant provisions of the existing 44 central labour laws into 4 codes to rationalize, consolidate and simplify the laws and launch the much awaited labour reforms. The proposed legislation is expected to benefit over 4 crore employees across the country; over 90% of which are in unorganized sector with job, wage and social security and boost the labour market flexibility.
The four codes include
- Code on Wages
- Code on Industrial Relations
- Code on Social Security and
- Code on Safety, Health & Working Conditions.
Besides codification, the (MoLE) aims to undertake number of initiatives for bringing transparency and accountability in enforcement of Labour Laws, which includes Nationalize the Labour Laws as well as activation of Universal Account Number(UAN).
